Compliance
Our commitment to legal and regulatory compliance
Credit Repair Organizations Act (CROA)
CreditWix is designed to help Credit Builders comply with the Credit Repair Organizations Act (CROA), a federal law that regulates credit repair companies. Key provisions include:
- Written Contracts: Credit repair services must be documented in a written contract
- Right to Cancel: Consumers have 3 business days to cancel without penalty
- No Advance Fees: Credit repair organizations cannot charge fees before services are fully performed
- Required Disclosures: Specific disclosures must be provided to consumers before signing
- Prohibited Practices: Making false claims, advising illegal actions, or charging for services not rendered
Note: CreditWix provides tools to help you comply with CROA. However, it is the Credit Builder's responsibility to ensure their business practices comply with all applicable laws.
Fair Credit Reporting Act (FCRA)
The Fair Credit Reporting Act governs how consumer credit information is collected, used, and shared. Our platform supports FCRA compliance by:
- Using legally compliant dispute letter templates based on FCRA provisions
- Documenting all dispute communications and responses
- Tracking the 30-day investigation timeline required by law
- Supporting consumer rights under Section 611 (dispute procedures)
- Facilitating proper verification of disputed items
State Regulations
Many states have additional credit repair laws that may be more stringent than federal requirements. Credit Builders are responsible for:
- Obtaining required state licenses and registrations
- Posting required surety bonds where applicable
- Complying with state-specific disclosure requirements
- Following state cancellation and refund policies
- Adhering to state advertising regulations
Important: Credit repair licensing requirements vary by state. We recommend consulting with a legal professional to ensure compliance with your state's specific requirements.
Data Protection and Privacy
We take data protection seriously and comply with applicable privacy laws:
- GLBA (Gramm-Leach-Bliley Act): Safeguarding consumer financial information
- CCPA (California Consumer Privacy Act): California residents' privacy rights
- SOC 2 Practices: Security, availability, and confidentiality controls
- Encryption: All sensitive data is encrypted in transit and at rest
- Access Controls: Role-based access to protect client information
Payment Processing Compliance
All payment processing is handled through Stripe, which maintains:
- PCI DSS Level 1: Highest level of payment card industry compliance
- Secure Payment Forms: Card data never touches our servers
- Fraud Detection: Advanced fraud prevention and monitoring
- Encryption: All payment data is encrypted using industry standards
FTC Guidelines
The Federal Trade Commission (FTC) enforces CROA and provides guidance on credit repair practices. Key FTC guidelines include:
- Truthful advertising without misleading claims
- Clear disclosure of consumer rights
- Prohibition of guaranteed results claims
- Required disclosure of "Consumer Credit File Rights"
- Proper handling of advance payments
Required Disclosures
Credit Builders must provide the following disclosures to clients before any contract is signed:
